1. Objet

These General Terms and Conditions govern the purchase of the products offered on the Website Anastore.com, owned by Anastore Bio S.L. (hereinafter, Anastore).

The purchase of any of the products entails the full and unreserved acceptance of each and every one of the General Terms and Conditions indicated, without prejudice to the acceptance of the Specific Conditions that may be applicable when purchasing certain products.

These General Terms and Conditions may be amended without prior notice, and it is therefore recommended that you read their contents carefully before purchasing any of the products offered.

Anastore, in compliance with Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market (‘Directive on electronic commerce’), hereby informs you that:

All notifications and communications between users and Anastore will be deemed to be effective, for all purposes, when made via any of the means indicated above.

4. Products

The products offered, together with their principal characteristics and price, are displayed on the screen.

Anastore reserves the right to decide, at any time, the products and/or services that are offered to Customers. Anastore may therefore, at any time, add new products and/or services to those currently offered. Similarly, Anastore also reserves the right to withdraw or cease offering, at any time and without prior notice, any of the products offered. Certain weights, measures and similar descriptions are approximate in nature, and are provided for illustrative purposes only.

All of the foregoing is without prejudice to the fact that the purchase of any of the products may only be made through the USER’s subscription or registration, with Anastore granting the person concerned a Username and password, which will identify and personally enable them to access the products.

Once inside Anastore.com, and to access procurement of the different products, the User must follow all the instructions indicated in the purchase process, which will entail the reading and acceptance of all the general and specific conditions set out at Anastore.com.

5. Availability and replacements products

Anastore aims to guarantee the availability of all products that are advertised through Anastore.com. However, if any product requested is not available, or if it has sold out, the customer will be informed by email or telephone as soon as possible.

If the product is not available, and if the consumer has been duly informed, Anastore may supply a product with similar characteristics without any increase in price, in which case the consumer may accept or reject it by exercising their right of withdrawal and termination of the contract.

If all or part of the order is unavailable, and the customer rejects the replacement products, the sum already paid will be refunded in the same way that it was paid, provided this falls within the returns period (and not by cheque). If the refund cannot be made to the card because the POS no longer permits it, a bank transfer will be made to the account number indicated by the customer.

If Anastore is unjustifiably late in reimbursing the sums paid, the consumer may claim double the sum due.

6. Trademarks

Certain trademarks, trade names, service marks and logos used or displayed on this Website are registered and unregistered trademarks, trade names and service marks of Anastore and its affiliates. Other trademarks, trade names and service marks used or displayed on this Website are registered and unregistered trademarks, trade names and service marks of their respective owners.

None of the content of this Website grants (and will not be construed as granting), whether by implication, based on the principle of estoppel etc., any licence or right of use over any trademarks, trade names, service marks or logos displayed on this Website, without the prior written permission of Anastore or their respective owners.

This Website may contain links to websites beyond the ownership, management or control of Anastore or its respective affiliates. Such links are provided solely for your convenience. If you use these links, you will leave this Website. 11. Purchasing and/or transaction process

To make any purchase on Anastore.com, the customer must be of legal age.

The customer is also required to be registered at Anastore.com by completing a data collection form that provides Anastore with the information required for the transaction. Such data must in all circumstances be a true, accurate and complete statement of your identity and the customer must expressly consent through the acceptance of Anastore’s privacy policy.

The steps to follow to make the purchase are:

  • 11.1 The user will be informed, prior to the completion of each purchase, of the exact amount of each of their orders.
  • 11.2 Purchases can be made online, by phone or by standard post.

t is also recommended that the customer print and/or keep a physical copy of the terms and conditions of sale when placing their order, as well as proof of receipt sent by Anastore.

12. Billing

The customer’s invoice will be available in the customer’s personalised access area under the section ‘bills’ within their order history.

13. Delivery

The maximum delivery time will depend on the type of shipping chosen.

As a general rule, orders placed before 11.30 am, Monday to Friday are shipped the same day. Orders received after 11.30 am will be shipped the next business day. You will receive an automatic email confirming shipment of your order on the day it is shipped.

14. Prices, costs and taxes

The prices of the products available at Anastore.com will be expressed in euros, unless otherwise stated, and will be guaranteed throughout their validity period, save for printing error, and regardless of the order destination.

15. Products

The final prices of all products (and, where applicable, the final prices per unit of measurement, where mandatory), together with their specifications, offers, discounts etc., are reflected in each of the items appearing in the catalogue at Anastore.com.

  • The product prices are inclusive of VAT
  • All products have a reduced VAT rate of 10%, except our cosmetics (Hevea range), whose VAT rate is 21%

Product prices may vary at any time. The applicable price will therefore be the price in force on the date the order is placed. In all cases, the final cost will be communicated to the customer in the electronic purchase process, before the customer confirms their acceptance.

16. Payment methods

We offer the following payment methods:

  • 16.1 By credit or debit card

    You can make payment immediately via the secure SSL payment gateway of our bank. If a return or cancellation of the order needs to be made, the sum paid will be refunded using the same payment card. Personal and bank data will be protected with all the security measures laid down by the Data Protection Act of 2018 and its Implementing Regulations, with complete confidentiality.

  • 16.2 By bank transfer

    By cash deposit or bank transfer. The customer’s name and order number must be indicated at the time of transfer.

  • 16.3 Cheque

    Download, print and complete the order form for your country, then send it together with a cheque for the same amount to the following address:

17. Returns and cancellations policy

According to regulations, consumers and users have the right to WITHDRAW from the contract for a maximum period of 14 calendar days, without the need to indicate a reason, and without incurring any cost, except those provided for in the directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011.

This right to withdraw does not apply, inter alia, to:

  • The supply of services already performed or begun.
  • Contracts for the supply of goods whose price is subject to fluctuations in financial market rates beyond the control of the company.
  • Contracts for the supply of goods prepared according to the specifications of the consumer or user or clearly personalised, or which, by their nature, cannot be returned or may deteriorate or expire quickly.
  • The supply of sealed goods that cannot be returned for health and safety reasons.
  • The supply of goods that after delivery have been mixed with other goods.

18. Products

The customer will have a maximum of 14 calendar days from the date of receipt of the goods or products ordered to inform Anastore of their desire to withdraw from the contract.

Withdrawal implies that Anastore will refund the amount already paid by the customer within 14 calendar days, following the same procedure chosen by the customer for payment (provided the product purchased is not listed among the exceptions indicated above).

During this period, the consumer will inform the company of their decision to withdraw from the contract, by completing the corresponding form found at the end of this document and sending it to Anastore’s email address.

Anastore will send the consumer an acknowledgement of receipt of such withdrawal on a durable medium.

To return a product, it is essential that the product is in perfect condition and in its original packaging, with all its accessories, and has not been used.

Once we receive their order, we will contact the customer to indicate the details of the return.

The customer will bear the costs of returning the goods.

19. Warranty

Products purchased through Anastore.com benefit from a warranty period from the time of their purchase, to cover any manufacturing defects.

Excluded from the warranties are consumables, deficiencies caused by use or by tampering.

The consumer warranty is determined by the expiry date or use-by date indicated on the container of each product.

20. Liability and disclaimer

The consumer and user have the right to have the product repaired, replaced, its price reduced or the contract terminated, in accordance with the provisions of the Directive 1999/44/EC of the European Parliament and of the Council of 25 May 1999 on certain aspects of the sale of consumer goods and associated guarantees.

If the product is not compliant with the contract, the consumer may choose between repair and replacement of the product, both of which are free of charge for the consumer, and which will be carried out within a reasonable period of time, according to the nature of the products and the purpose for which they were intended.

If once the repair and delivery of the product is completed, it is still not compliant with the contract, the consumer may request its replacement, a reduction in the price or the termination of the contract.
